Sex Crimes:

Conviction for any sex crime can have repercussions far beyond even the severe legal penalties issued by the courts. In addition to incarceration, conviction of a sex crime can cause long-term employment and career problems and can also lead to permanent restrictions on where you can live.

Often, a conviction isn't even necessary to bring serious problems. Even the knowledge of your charges can ruin your reputation and lead to feelings of embarrassment and seclusion.

Attorney Marcos Garza has handled many sex crime defense cases and can help you with confidential, compassionate and informative legal counsel. Sex crimes include rape, forcible sodomy, molestation, statutory rape, unlawful sexual intercourse, sexual battery, Internet crimes, rape of a child, enticement or solicitation of a minor on the Internet, the possession or distribution of child pornography, and sex with a minor. Even if we cannot prove your innocence, we may be able to show mitigating circumstances that may significantly reduce your charges.

Child Pornography:

The state of Tennessee, with help from the ICAC, aggressively investigates and prosecutes sex offenders. To prevent the distribution and possession of child pornography, local, state and federal investigators actively monitor the Internet.

They look for key terms you may use in an Internet search that look suspicious and they also create fake computer accounts to interact with potential suspects on chat sites and other websites that might be frequented by sex offenders.

If the authorities believe that you may be searching for child pornography or distributing child pornography, they may seek a search warrant to seize your computer. More frequently, however, the authorities will try to conduct informal interview, Basically, they come to your home without a search warrant and ask for your consent to search your home and take your computer.

Most people do not know their rights, so they consent to the search. While these searches are legal if a person gives their consent, you have no obligation to grant your consent to a search unless the police have a search warrant.

Child Rape or Molestation:

The molestation of a child is a very serious charge that carries severe criminal penalties in the state of Tennessee. If you have been accused of having sex with a minor, you will be charged with sexual abuse of a child, which is a felony. If you were in a position of trust, you may be charged with aggravated sexual abuse of a child by an authority figure, which is also a felony.

Internet Sex Crimes.

Accusations of Internet sex crimes are serious. Once an allegation is made, there is absolutely no turning back - you will likely face a whirlwind of embarrassment, public stigma, employment problems, and many other problems, even if you are ultimately acquitted (or charges are either never filed or dropped). Unfortunately, in cases involving Internet sex crimes, "innocent until proven guilty" is unheard of by the public, media and even the prosecution. You need a lawyer who has the knowledge and determination to go up against everything that is against you.

Statutory Rape:

If you have had sex with a minor, you can be charged with statutory rape. In the state of Tennessee, sex with anyone under the age of 18 is a crime, regardless of whether or not it was consensual.

If you have been accused of sexual conduct with a minor, sexual assault, unlawful sexual intercourse or another sex related offense, contact the Garza Law Firm.
